  • During labor (failure to monitor fetal strips; delayed C-section)

  • During the immediate postpartum time frame (failure to diagnose or treat jaundice)

Normally, the statute of limitations for bringing an injury lawsuit is two years. In the case of birth injuries, however, a longer allowable time period for suing is longer — as long as 7 years — since learning disabilities may not surface until a child starts school. The possibility that a fetus's oxygen deprivation during birth could have caused learning disabilities appearing years later is worthy of investigation when parents need to know.
